GENERAL TERMS AND CONDITIONS OF USE AND PRIVACY POLICY

These general terms and conditions of use (hereinafter the "T&Cs") are applicable to the website accessible at the address www.leciel-sainttropez.fr (hereinafter the "Website"), operated by the company LE CIEL, of which the registered office is at 2, rue du CEPOUN SAN MARTIN 83990 SAINT-TROPEZ registered in the FREJUS Trade and Companies Register under number 882627425

Article 1 – General information – Application of the General Terms and Conditions

1.1 The purpose of the T&Cs is to determine the conditions under which any person (hereinafter the “Customer”) can make a reservation request (hereinafter the “Reservation”) in order to benefit from the catering services offered by the LE CIEL restaurant located at 2, rue du CEPOUN SAN MARTIN 83990 SAINT-TROPEZ (hereinafter the “Contract”).

1.2 The T&Cs are made available to Customers on the Website where they are directly searchable and accessible at any time.

The T&Cs apply, without restriction or reservation and automatically, to any Reservation by a Customer via the Website or by telephone on +33 (0)7 61 00 53 65. These T&Cs are the only ones applicable to the exclusion of all others. The T&Cs will prevail, where applicable, over any other version or any other contradictory document.

The Contract takes effect on the date of validation of the Reservation for the period necessary to carry out the reserved catering service, unless cancelled under the conditions provided for in Articles 4 and 5 below.

The implementation of the Reservation procedure implies acceptance of the T&Cs.

1.3 Le CIEL reserves the right to modify the T&Cs at any time and without notice. The modifications of the T&Cs are enforceable against the Customers from the moment they are posted on the Website. The T&Cs applicable to the Customer are those in force on the Website on the date of confirmation of the Reservation.

The Customer acknowledges and guarantees that he/she has the capacity and the required age (legal age) to enter into a contract and/or make a Reservation on the Website.

Article 2 – Booking procedures

2.1 Subject to availability, the reservation request can be made by telephone on +33 (0)7 61 00 53 65 or on the internet, via the Website, on the online form accessible under the "Reservation" tab (hereinafter the "Form"). To make a Reservation on the Website, the Customer must complete the fields on the Form. In particular, in addition to his/her identity, the Customer must indicate the date on which he/she wishes to benefit from the catering services as well as the service (lunch or dinner), the time, and the number of seats required. 

2.2 Only the confirmation of the reservation request by the restaurant Le CIEL constitutes an effective reservation. The acceptance of the Reservation is confirmed to the Customer by sending an email to the email address indicated by the latter in the Form as a confirmation summarizing the elements of his/her Reservation (date, service, time, number of seats, etc.) or by text message. It is the Customer's responsibility to check the elements indicated in the confirmation email and, if applicable, to notify any reservation error to the Le CIEL restaurant as soon as possible and at the latest 48 hours before the reservation date.

In the event that the Customer does not receive a confirmation email, it is up to him/her to contact Le CIEL as soon as possible.

2.3 Le CIEL reserves the right to refuse any Reservation which it deems to be contentious or fraudulent and any Reservation by a Customer with whom there is a dispute of any kind, past or in progress, and in particular a dispute relating to the payment of a previous Reservation.

Article 3 – Price

The Customer will pay the amount of the addition of the meal corresponding to the services provided in LE CIEL restaurant directly and in full on the spot, on the day specified during the Reservation.

The prices displayed in the menu on the Website are indicated in euros, service and all taxes included. They are however shown for information only and may be subject to modification due in particular to the seasonality of the products, the content of the menus, etc.

Article 4 – Modification and cancellation of the Reservation

4.1 Any changes to the Reservation requested by the Customer, in particular the date of the Reservation, the number of seats, etc., must be notified without delay by the Customer to Le CIEL restaurant, up to 48 hours before the date and the time initially provided for in the Reservation, imperatively specifying the details of the initial Reservation (name, date, time, number of seats) and any changes required,

  • by clicking on the link provided for this purpose contained in the Booking confirmation email or text message; or
  • by sending an email to the address info@lecielsainttropez.fr (date and time of the sending of the email received by the Company as proof).

Failure to meet this deadline and/or in the event of a lack of availability or when Le CIEL restaurant would not be able to meet requests for changes for any reason whatsoever, the Customer may cancel the Reservation within the conditions defined in Article 4.3 below.

4.2 In accordance with the regulations in force and in particular with Article L. 121-21-8 of the Consumer Code, the right of withdrawal cannot be exercised for catering services which must be provided on a specific date or period.

4.3 The Customer may cancel a Reservation, free of charge, no later than 48 hours before the date and time initially provided for in the Reservation. In order to cancel a Reservation within this 48 hour period, the Customer can:

  • click on the link provided for this purpose contained in the Booking confirmation email; or
  • send an email to the address info@lecielsainttropez.fr (date and time of the sending of the email received by the Company as proof), imperatively specifying the details of the Reservation (name, date, time, number of seats).

Article 5 – Liability

5.1  Le CIEL restaurant undertakes to provide catering services, for the number of seats, on the day and at the time indicated in the Booking confirmation sent to the Customer. It cannot in any way be held responsible for direct or indirect damage resulting from the failure of the Customer to show up on the day and at the time indicated in the Booking confirmation, in particular in the event of oversight, error or failure by the Customer to receive confirmation of his/her Reservation.

5.2 In the event of force majeure such as fire, strikes, impossibility of supply, stoppage of transport which would tend to delay or prevent the execution of the supply, this would be a cause of suspension or cancellation of the obligations of Le CIEL restaurant, without compensation for the benefit of the Customer.

Article 6 – Personal data protection policy

6.1. GDPR

In accordance with the General Data Protection Regulation No. 2016/679 relating to the protection of individuals with regard to the processing of personal data and the free movement of such data (known as "GDPR"), the User is informed that the CIEL, in its capacity as data controller, implements the processing of personal data within the framework of the use of the Website.

The company, concerned about the confidentiality of the personal data of users of the website and of Holidaymakers, is strengthening its policy on the protection of personal data in order to comply with the obligations by the Regulations in force and in particular, the obligations provided for by the GDPR.

In accordance with the law, the user is informed of the need to collect certain information (name, first name, postal address, email address, etc.), in order to notify the user of the validation of his/her reservation.

The company LE CIEL is committed to ensuring that the collection and processing of your data, carried out from the website, complies with the general data protection regulations (GDPR) and the Data Protection Act.

Each form or teleservice only collects the personal data that is strictly necessary (minimisation of data) and states, in particular:

  • what are the objectives of the data collection (purposes);
  • whether this data is mandatory or optional for the processing of your request;
  • who shall be able to consult this data (exclusively Le CIEL, in principle, unless specified in a form when it is necessary to send data to a third party for the management of your request);

Each submission via a form is subject to consent. This consent is recorded in the database for a period of one year.

Personal data collected within the context of services offered on the website are processed in accordance with secure protocols and allow requests received in its IT applications to be processed.

For any information or to exercise your IT rights and freedoms in relation to the processing of personal data managed by Le Ciel, and in particular the deletion of your personal data, you can contact its data protection officer (DPO):

6.2. Privacy policy

This privacy policy applies to the website of the Le CIEL restaurant in the European Economic Area.

The information we collect is limited to the contact details provided by the user as part of their inquiries. Le CIEL does not collect any banking or financial data. No partner can have access to your personal data.

At no time does the company sell or give away this personal data.

By providing their personal information on our platform, Users agree to their collection, and their storage and/or processing as defined by these terms and conditions. It is up to the User not to enter any information that he/she would like to keep confidential.

The main purpose of using this personal data is to provide Users with a service that meets their expectations as closely as possible:

  • to ensure the accuracy of their identity,
  • to notify them of newsletters offering rental properties,
  • to establish ties with them as part of the requested services,
  • to improve our services and our website,
  • to detect and prevent any non-compliant illegal activity,
  • This personal information may also be used in the context of a dispute over the use of our website, the rental of a villa and for the purposes of protecting our rights and interests.

No international transfer of this data is carried out by the Company.

We use reasonable technical, administrative and physical safeguards to protect the privacy and security of your personal information. We use industry-recognized technical protections, such as hardware and software firewalls, and have adopted and implemented security procedures to protect your information against loss, misuse, or unauthorized modification. Despite our best efforts, we cannot guarantee absolute or unreserved protection of this information given the open nature and resulting instability on the internet, and we do not guarantee the effectiveness of our security and disclaim all liability in the event a breach of security or any failure of the security of your computer equipment, your Internet service provider or other networks and communications providers.

8. Google Maps

On our website we use Google Maps (API) from Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA ("Google"). Google Maps is an internet service for displaying interactive maps in order to visually display geographic information. Using this service shows you where the rental villas are located.

When you access the subpages containing the map of Google Maps, information about your use of our website (e.g. IP address) is transmitted and stored by Google on servers in the USA. This is regardless of whether or not Google provides you with a user account with which you are logged in or whether there is no user account. Your information is directly associated with your account if you are signed into Google. You must log out before activating the button if you do not wish to be associated with your Google profile. Google LLC, based in the United States, is certified as compliant with the European Data Protection Agreement “Privacy Shield”, which ensures compliance with the level of data protection applicable within the EU.

If you refuse the future transmission of your data to Google in the context of the use of Google Maps, you can also completely disable the Google Maps web service by deactivating the JavaScript application in your internet browser. 9. Applicable law and competent jurisdiction

These T&Cs are governed and interpreted in accordance with French law. In the event of a dispute, the French courts will have jurisdiction.
